Terms of Agreement and Data Protection

  1. Object
    a. These conditions of participation and data protection are regulating govern participation in the competition "Team Alpecin" of Dr. Kurt Wolff GmbH & Co. KG, Johanneswerkstraße 34-36,33611 Bielefeld (hereinafter referred to as "Organiser"), the transfers of rights required in connection with participation as well as the collection and use of the data collected or communicated by the Participants.
    b. By participating in the competition, participants accept these conditions of participation and declare their consent to the collection, processing and use of their personal data to the extent shown below.

  2. Conditions of participation in the competition
    a. The competition starts on Tuesday February the 13th 2018 and ends on Wednesday February the 21st 2018 (23:59 CET).
    b. Entitled to participate are persons who are older than 18 years of age. Excluded are employees of the organizer and employees of cooperation partners who are or were involved in the creation or handling of the competition, as well as relatives and relatives of these persons.
    c. A person participates in the competition by clicking on the corresponding competition link in the corresponding E-Mail.
    d. 50 winners shall be randomly selected from all persons meeting the conditions set out in point 2 c) above. They will then receive a package consisting of 1x Team KATUSHA ALPECIN Replica Jersey, 1x Team KATUSHA ALPECIN Replica Bibshort. The winners will be notified via E-Mail.
    e. Multiple participation is excluded. Only one prize can be won per participant.
    f. If circumstances arise which are beyond the control of the organizer, the respective winner accepts a reasonable substitute prize.

  3. Rights of use, exemption, responsibility and possibility of exclusion
    a. The organizer is not obliged to check the content provided by the participants for potential infringements of the rights of third parties. However, the organizer is entitled to reject them if the contents are illegal in his opinion or offend against common decency.
    b. The Participant warrants that the submitted entry and each of its components has been created by himself/herself, that it is a completely original work which the Participating User has created in its entirety and that the Participating User is the sole owner of all rights to the submitted Content in all respects. If the participant is not the sole author or copyright holder, he expressly declares that he has the necessary rights to participate in the competition. The participants shall indemnify the organizer against all claims of third parties arising from the content provided to the participants. You agree to support the organizer in any reasonable way in defending against these claims.
    c. Participants hereby agree that their entries in connection with the sweepstake, the draw, processing and presentation of the entries will be used, distributed and disseminated free of charge by the organizer in online and offline media (e. g. in the print media) and made publicly accessible to third parties in other ways. For these purposes, the organizer is also permitted to process the submissions and, if necessary, grant rights of use to third parties. This right is granted free of charge and without any spatial, content-related or temporal limitation.
    d. Violation of these conditions of participation entitles the organizer to exclude the respective participant from participation. This applies in particular if the participant provides false information or uses photos or other contents (e. g. comments) violate applicable law or third party rights. The same shall apply to comments that can be regarded as glorifying violence, offensive, harassing or degrading or otherwise violate social decency. If the excluded participant is an already determined winner, the prize can be withdrawn afterwards.

  4. Handling
    a. Winnings cannot be paid out in cash or in kind, exchanged or transferred to other persons. A participant can forego the prize. In this case, the next participant in the order of the winners will take his place. The prizes will be sent to the winners.
    b. The winners will be determined within three days after the end of the competition, notified by e-mail and asked for confirmation.
    c. If a participant does not confirm the acceptance of the prize within a period of 10 days, the prize will be forfeited. If the given contact possibilities should be faulty (e. g. invalid email addresses) the organizer is not obliged to search for correct addresses. Disadvantages resulting from incorrect contact data are to be borne by the participants.
    d. The organizer reserves the right to terminate the lottery at any time, even without adherence to deadlines, in whole or in part, or to change its course if it is not possible for technical reasons (e. g. computer virus, manipulation or errors in software/hardware) or legal reasons (e. g. prohibition by Facebook) to guarantee a proper execution of the lottery.

  5. Exclusion of warranty
    a. The organizer points out that the availability and function of the competition cannot be guaranteed. The competition may be terminated or removed due to external circumstances and constraints without any claims of the participants against the organizer.
    b. This may include, in particular, technical problems, rule changes or decisions made by platforms such as Facebook if the sweepstake is hosted on or in connection with them.

  6. Liability
    a. The organizer's liability for damages shall be governed by the following exclusions and limitations of liability, without prejudice to the other statutory conditions of entitlement in accordance with this Clause 6.
    b. The organizer is liable without limitation if the cause of damage is based on intent or gross negligence.
    c. Furthermore, the organizer is liable for the slightly negligent violation of essential obligations, whose violation jeopardizes the achievement of the purpose of the contract, or for the violation of obligations, whose fulfilment makes the proper execution of the competition possible in the first place and on whose observance the contractual partners regularly trust. In this case, however, the organizer is only liable for foreseeable, contract-typical damage. The organizer is not liable for the slightly negligent breach of duties other than those mentioned in the above sentences.
    d. The aforementioned limitations of liability shall not apply in the event of injury to life, limb and health, for a defect after acceptance of quality guarantees for the quality of a product and for maliciously concealed defects. Liability under the Product Liability Act remains unaffected.
    e. Insofar as the liability of the organizer is excluded or limited, this also applies to the personal liability of the organizer's employees, representatives and vicarious agents.

  7. Data protection information
    a. The organizer collects, processes and uses the data of the participants only to the extent permitted by law or with the consent of the participants.
    b. The following data will be collected, processed and used by the organizer for the design, implementation and handling of the competition by the participants: first and last name of the participant, date of birth, address, e-mail address.
    c. Upon written or written request, the participants may at any time demand information from the organizer as to which personal data is stored by the organizer, may request their correction and deletion by e-mail to socialmedia@ewolff.team and may revoke their consent to the use of data.
